Standard operational, manufacturing, architectural design, and on-site execution terms governing contracts with M D Parmar & Associates.

Commercial Contracting Guidelines

These Terms of Service ("Agreement") govern all contracts, purchase orders, letters of intent (LOI), and architectural service engagements executed between M D Parmar & Associates (the "Contractor") and the hiring client, architect, or enterprise entity (the "Client").

Signing a formal quotation, issuing a work order, approving an AutoCAD space layout, or transferring a project mobilization advance constitutes formal acceptance of these terms.

1. Scope of Work & Engagement

The exact scope of civil alterations, false ceiling installation, MEP engineering, and modular furniture fabrication is defined exclusively in the mutually signed Bill of Quantities (BOQ).

  • Any addition, modification, or deviation from the signed BOQ requested by the Client or their PMC shall be treated as an "Extra Item" and quoted separately with corresponding time extensions.
  • Verbal instructions on site must be confirmed in writing (via email or site logbook) before execution commences.

2. Architectural Drawings & Intellectual Property

All custom 2D layout drawings, 3D photorealistic renderings, shop drawings, and factory cutting lists prepared by MD Parmar & Associates remain the intellectual property of the firm until full settlement of contractual dues.

  • Drawings and engineering specs may not be shared with competing third-party contractors for external manufacturing without prior written consent.
  • Upon project sign-off and final payment, the Client receives a non-exclusive license to utilize the installed interior design.

3. Material Specifications & In-House Fabrication

All plywood, laminates, veneers, hardware fittings, and electrical components adhere to the specific brands indicated in the contract (e.g., CenturyPly, Greenply, Merino, Blum, Hafele, Schneider, Polycab):

  • All modular furniture carcasses and shutters are fabricated at our Nalasopara factory with 0.1mm CNC precision, multi-boring, and 2mm PUR edge banding.
  • Natural materials like natural veneers, Italian marble, and solid wood grains inherently possess natural variations in color, figure, and grain patterns, which are celebrated hallmarks of genuine luxury materials.

4. Site Readiness, Clearances & Access

To maintain accelerated project handover schedules (e.g., 30–60 days), the Client must ensure the following site prerequisites:

  • Unrestricted, unhindered site access for workforce crews, material delivery vehicles, and equipment.
  • Continuous three-phase commercial electric power and running water supply required for on-site execution.
  • All statutory society permissions, landlord No Objection Certificates (NOCs), mall working hour clearances, and local municipal permits.

5. Warranties & Defect Liability Period (DLP)

We take immense pride in our engineering precision and provide comprehensive warranty coverage:

10-Year Factory Core Warranty

Covers IS:710 BWP plywood carcasses and modular joinery against delamination, manufacturing defects, and borer/termite attacks.

Hardware Manufacturer Warranty

Blum, Hafele, Hettich moving hinges, lift stays, and tandem drawer channels carry original OEM replacement warranties.

6. Governing Law & Legal Jurisdiction

This Agreement and all associated commercial purchase orders shall be governed by and construed in accordance with the substantive laws of the Republic of India.

Any disputes, claims, or controversies arising out of or relating to project execution, invoicing, or warranty fulfillment shall be subject to the exclusive jurisdiction of the competent courts in Mumbai / Thane, Maharashtra.
